Terms & Conditions

These Terms & Conditions apply to the purchase of software licenses and services from OM Labs e.U. (Hofstattweg 14, 6710 Nenzing, Austria) via om-labs.com.

1. Scope

These terms govern all contracts between OM Labs and its customers for the purchase of software licenses and related services, whether the customer is a consumer or a business.

2. Conclusion of contract

A contract is concluded when you complete checkout and payment is confirmed. You will receive an order confirmation and, where applicable, your license key by email.

3. Prices & payment

All prices are shown in EUR. OM Labs operates as a small business (Kleinunternehmer) and is currently exempt from VAT under § 6 Abs 1 Z 27 UStG; no VAT is added. Payments are processed securely via Stripe.

4. Delivery & license activation

Licenses are delivered digitally, typically immediately after payment is confirmed. Activation is handled via the OM Labs Licensing platform.

5. Right of withdrawal (consumers)

If you are a consumer within the EU, you generally have the right to withdraw from this contract within 14 days without giving a reason. Because our products are digital content, this right ends once delivery/activation has begun with your express consent and acknowledgement that you thereby lose your right of withdrawal (Art. 16(m) EU Consumer Rights Directive).

6. Warranty & liability

We provide our software with reasonable care and skill. Statutory warranty rights apply. Our liability for indirect or consequential damages is excluded to the extent permitted by law.

7. Governing law & jurisdiction

These terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory consumer-protection provisions of their country of residence remain unaffected. Place of jurisdiction, to the extent legally permissible (business customers only — consumer venue rules remain unaffected): Landesgericht Feldkirch, Austria.

8. Severability

Should any provision of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
